Terms & Conditions

These Terms and Conditions (“Terms”) govern the provision of services and digital products by Top Margin, including its directors, consultants, contractors, and authorised representatives (collectively referred to as “Top Margin”). By purchasing services, courses, or other products from Top Margin, you agree to be bound by these Terms.

1. Services and Digital Products

Top Margin provides:

  • Professional résumé writing and career services

  • Strategic résumé review services

  • Online courses and training programs

  • Digital downloads and educational materials

  • Published books and related resources

These Terms apply to all purchases unless otherwise agreed in writing.

2. Payment Terms

2.1 Full payment is required before the commencement of any writing or review services.

2.2 Digital products and courses must be paid in full at the time of purchase.

2.3 Prices and quotes are valid for sixty (60) days unless otherwise stated.

3. Refund Policy – Services

3.1 Change of Mind
Payments for services are non-refundable once writing has commenced.

Top Margin will work collaboratively with clients through the agreed revision process to ensure the final document meets the strategic brief. Dissatisfaction alone does not constitute grounds for a refund.

3.2 Partial Refund Prior to Writing
If a client cancels a service before writing has commenced and within sixty (60) days of purchase, Top Margin may issue a partial refund. The amount refunded will reflect consultation time, preparatory work, and administrative costs incurred up to that point.

3.3 Project Termination by Top Margin
Top Margin reserves the right to terminate a project at any stage. If termination occurs, a refund may be issued at Top Margin’s discretion, taking into account work completed to date.

3.4 Project Activation Window
Clients may activate or continue a purchased service within two (2) years of the original purchase date unless otherwise agreed.

4. Refund Policy – Digital Products and Courses

4.1 Due to the immediate access provided upon purchase, digital products, downloadable materials, and online courses are non-refundable once access has been granted, except where required under Australian Consumer Law.

4.2 Change of mind does not constitute grounds for refund of digital products.

4.3 Course access is provided for the duration stated at the time of purchase. If no duration is specified, access remains available while the course is maintained on the platform.

5. Revision and Editing Policy

5.1 Service packages include the number of revision rounds specified at the time of purchase.

5.2 Additional revisions beyond the included scope may incur additional fees.

5.3 Clients are responsible for reviewing draft documents and identifying factual inaccuracies. Top Margin is not liable for errors arising from information supplied by the client or not identified during the revision process.

6. Employment Outcomes Disclaimer

Top Margin provides professional writing and strategic guidance. No guarantee is made regarding job interviews, offers, or employment outcomes, as these depend on multiple external factors beyond Top Margin’s control.

7. Client Responsibilities

Clients agree to:

  • Provide accurate and complete information

  • Respond to requests in a timely manner

  • Review draft materials within thirty (30) days of delivery

Failure to engage within a reasonable timeframe may result in the project being paused or closed.

8. Intellectual Property

8.1 All course materials, written content, templates, audio files, educational resources, and digital products remain the intellectual property of Top Margin unless otherwise agreed in writing.

8.2 Clients are granted a personal, non-transferable licence to use purchased materials for their own career development.

8.3 Materials may not be shared, reproduced, distributed, resold, or publicly displayed without written permission.

8.4 Top Margin may use anonymised and substantially altered excerpts of work for educational or promotional purposes. Identifying details will be removed or altered.

9. Online Account Responsibility

Clients are responsible for maintaining the confidentiality of their login credentials and for all activity conducted under their account.

Sharing access to courses or digital materials is prohibited.

10. Technical Limitations

Top Margin makes reasonable efforts to maintain platform availability but does not guarantee uninterrupted access due to maintenance, hosting providers, or third-party service interruptions.

Top Margin is not responsible for compatibility issues arising from a client’s personal devices or software systems.

11. Limitation of Liability

Top Margin shall not be liable for indirect, incidental, or consequential loss arising from the use of services or products.

Clients agree to indemnify Top Margin against claims arising from inaccurate information supplied by the client.

Top Margin, including its directors, consultants, contractors, and authorised representatives, shall not be liable for any indirect, incidental, or consequential loss arising from the use of services or products.

Advisory Services Disclaimer

Executive and strategic advisory services provided by Top Margin, including those delivered by its directors, consultants, contractors, or authorised representatives, are based on professional judgement, experience, and information available at the time of engagement.

Such advice is intended to support informed decision-making but does not constitute financial, legal, or employment guarantees. Clients remain responsible for their own decisions, actions, and outcomes, including the application of any advice or recommendations provided.

Top Margin shall not be liable for outcomes arising from the interpretation, application, or reliance upon advisory guidance.

12. Australian Consumer Law

Nothing in these Terms excludes or limits rights available under Australian Consumer Law. Where services or products fail to meet statutory guarantees, remedies will be provided as required by law.

13. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia.
